1. Introduction and definitions
By using our services, you confirm that you have read and understood these Terms of Use and agree to be bound by them. Do not use the website or our services if you do not agree to these Terms of Service.
These Terms of Service ("Terms of Use") apply between the digital services provided by Kontakto Oy ("Kontakto" or "Service Provider"), such as the website kontakto.fi and the business information search service ("Service") and their users (“Users”). These Terms of Service apply to all services under the kontakto.fi domain name, including the interface (api.kontakto.fi). If there is a separate Agreement or accepted offer between the User and the Service Provider, the terms of the Agreement shall apply primarily if they deviate from these Terms of Service.
The following terms are used in these Terms of Service:
- "User" means individuals browsing the website kontakto.fi, including legal entities.
- "Service" means the services and related interfaces provided by Kontakto through the website.
- "Website" means the website maintained by Kontakto under the domain name kontakto.fi and all related domain names.
- "Content" means all information, text, software, images, graphics, videos, messages or other material made available through the Service.
- "Interface" means the programming interface that allows users to access and integrate Kontakto's business search features.
- "Personal data" means any information that can be used to identify a natural person, directly or indirectly, and that enables identification in accordance with the General Data Protection Regulation (GDPR).
2. Service description
Kontakto offers a developer-friendly, fast and affordable business information search service. With our service, Users search and retrieve business information through our website or interface. The service is primarily designed for business use, but it is also available to individual consumers.
Use of the Service requires registration and, for certain features, payment. Registered users can use the Service to generate a key that allows them to use the interface. While we strive to ensure that the Service is available continuously without interruption, we cannot guarantee access to the Service. The Service Provider is not responsible for any downtime, service interruption or loss of data. The Service Provider reserves the right to change, suspend or terminate the Service at any time without prior notice.
3. User accounts
To use some features of the Service, you must register an account. Registration for the Service requires that you be of legal age and have legal capacity. When registering, you agree to provide accurate, up-to-date and correct information about yourself and your company. The Service Provider will conduct checks on the accuracy of the information provided and the financial situation of the companies before granting you the right to use the Service.
The Service Provider grants access to the account after the User accepts these Terms of Service, as well as any separate agreements for paid Services (“Agreements”). The Terms of Service and any Agreements that you accept constitute the entire agreement between the Service Provider and you. The User is responsible for maintaining the confidentiality of the account identification information and for all activities that occur under the account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
The user is responsible for the accuracy and timeliness of the information provided. The user undertakes to update their information when necessary. The service provider reserves the right to close accounts that contain incorrect or outdated information.
4. User responsibilities and prohibited actions
You agree to use the Service in accordance with these Terms of Service only for lawful purposes. The content of the Service is based primarily on publicly available information. The Service Provider grants you the right to use the Service only for purposes necessary for normal business operations.
All users have the right to use the credit information of companies. The user is responsible for ensuring that he or she has the legal right to use the personal information. The personal identification number of the responsible person of the company is disclosed in its entirety only to Users who have a basis for processing the personal identification number in accordance with the Personal Data Act.
The information provided by the Service may not be sold to third parties, but may be shared if no commercial benefit is sought. Information obtained from the interface may not be used to produce mass marketing services. The User has the right to use the information obtained from the Service as part of their own systems.
It is specifically prohibited to:
- Use the Service in a manner that overloads or damages the Service.
- Interfere with other parties' use of the Service.
- Create multiple user accounts to circumvent reasonable free usage restrictions.
- Share user rights with third parties who do not represent you as a user or the company you represent.
- Use the Service for illegal or fraudulent purposes.
5. Intellectual property rights
All intellectual property rights in the Service and the Site belong to Kontakto Oy or its licensors. You may only use the information for your own internal lawful activities in accordance with these terms and the Agreement. You may not use the information for activities that compete with the Service Provider or conflict with the interests of the Service Provider. Copying, modifying, combining, redistributing and reusing the information is prohibited without the written permission of the Service Provider.
6. Payment terms
The prices of the Services are published on our website. The prices are valid until further notice. The Service Provider has the right to change the pricing of the Service and you will be notified of any price changes by email or when you use the Website. If you do not accept the announced price changes, you may terminate your paid subscription.
Some services are priced based on usage. Some services are subject to an ongoing subscription fee. Prices are subject to the current value-added tax.
All sales are final and we do not offer refunds unless required by law or otherwise expressly stated in these Terms of Service.
7. Term and expiration of the agreement
These Terms of Use are valid until your use of the service ends. You can terminate your paid subscription at any time with 30 days' notice via your user account or by sending a termination request by email to support@kontakto.fi. The Service Provider may terminate your account unilaterally if you fail to comply with these Terms of Service.
8. Data protection
The Service Provider processes information on its Website confidentially. Legislation and official regulations allow individuals to check their information in credit inquiries. The User must ensure that they maintain the requirements of data protection legislation and is responsible as a data controller for the lawful processing of personal data.
The transfer of personal data outside the EU and EEA countries is prohibited. The user is obliged to train and supervise its personnel so that the legal protection of data subjects is implemented in the processing of personal data. The service provider's obligation in the processing of personal data is published in the privacy policy required by law on the Kontakto Website.
9. Warranties and errors
The Service is provided "as is" and "as available", without warranty, including warranties of merchantability, fitness for a particular purpose or non-infringement of rights. The Service Provider does not guarantee that the Service will be uninterrupted, timely, or error-free. Although the Service Provider strives to ensure that its services are of the highest possible standard and reliable, we cannot guarantee the suitability of the services for the User's purposes.
If the Service contains an error for which the Service Provider is responsible, you have the right to request that the error be corrected or the contract be terminated, unless the error is minor. The Service Provider will strive to correct the error within a reasonable time and in a way that does not cause you any costs or significant inconvenience.
10. Limitation of liability
The Service Provider is not liable for any direct or indirect damages that may arise from the use of the Service, unless otherwise provided by mandatory legislation. Indirect damages include, but are not limited to, credit losses, loss of income, or loss of business opportunities that arise indirectly from the use of the Service. In particular, credit losses are expressly considered indirect damages under these Terms of Service.
The Service Provider's liability for direct damages is limited to the amount paid by the User to the Service Provider during the six (6) months preceding the damage.
Unless otherwise provided by law, the Service Provider is not responsible for:
- Technical operational problems
- Lack of availability or supply of services
- Communication problems caused by third parties
- Errors in the service or the timeliness of information
- Any indirect damages, such as lost profits or damage or reduction or interruption of turnover
- The suitability of the information for the user's purposes
11. Force majeure
The Service Provider and the User are released from their obligations under the Terms of Service for such time and to the extent that the failure to fulfill the contractual obligations is due to force majeure. Such an event is, for example, war, general traffic disruption, energy supply interruption or disruption, large-scale labor dispute, fire, exceptional natural phenomenon or other similar and unusual cause beyond the control of the User or the Service Provider.
12. Changing the Terms of Service
These Terms of Use apply to all Services maintained by the Service Provider, unless otherwise agreed in writing between the parties. The Service Provider has the right to unilaterally change the Terms of Service and service-specific terms. The Service Provider shall notify the User of any changes to the Terms of Service. The changes shall enter into force immediately. By continuing to use the Service, the User accepts the changed terms and agrees to comply with them.
13. Transfer of rights and obligations
The User does not have the right to transfer the right to use the Service or any agreement made regarding the Service to a third party without the written consent of the Service Provider. The Service Provider has the right to transfer the agreement to a third party. The agreement between the User and the Service Provider under these Terms of Service is valid until further notice. Either party may terminate this agreement at any time with immediate effect upon receipt of a notice of termination by the other party. Termination shall terminate the User's right to use the Service. The User shall be liable for all of their responsibilities and obligations under this agreement until the termination takes effect.
14. Resolving disagreements
All disputes, disagreements and claims related to the Terms of Service or use will primarily be resolved through negotiations between the parties. If the parties are unable to find a solution through negotiations, the disputes will be resolved in the Helsinki District Court.
15. Applicable law
The Terms of Service are governed by Finnish law.
16. Cooperation with authorities
If necessary, the Service Provider may assist the police and other authorities in investigating possible abuses by disclosing the User's information to them, to the extent known to the Service Provider.
